Ivan Wasserman Quoted in “SCOTUS to Decide Case on Government Power”
Ivan Wasserman spoke to Danielle Masterson, NutraIngredients-USA, about what it could mean to the dietary supplement industry if the Supreme Court overrules the longstanding legal precedent known as the Chevron Doctrine.
Ivan explained that per the Doctrine, courts ‘give deference’ to a federal agency’s interpretation of the statute it operates under. Overturning this may not have an immediate impact on the dietary supplement industry, but it could have a very significant impact going forward.
While a challenger could successfully argue that its interpretation of a statute was correct and the agency’s was wrong, it is a big, uphill battle. If the Supreme Court overturns that precedent, that hill could be a lot easier to climb.
