NutraIngredients-USA turned to FTC & State Advertising Compliance Practice Group Co-Chair Jennifer Adams for comment on the latest in a series of cases spotlighting the intersection of clinical substantiation, demographic targeting, and compliance with advertising standards in the dietary supplements sector.

Jennifer stated, “This case highlights that study design matters more than the results. NARB’s decision reemphasizes longstanding FTC guidance that the study population must match the targeted demographic.” She advised that “narrowly tailoring study populations can help ensure a good fit with the product’s advertising,” noting that “if there is a reason the study demographic is perhaps broader than the product’s target, carefully pre-planned and powered subgroup analyses can protect credibility and applicability.”
